新鑽表交貨變二手 珠寶公司判還百萬

曾姓婦人向珠寶公司購買鑽石項鍊、變形珠耳環墜鍊、翡翠鐲子及名牌鑽石機械表等首飾，一共花費474萬多元，但交貨後認為多件首飾品質差，鑽表還是二手石英表，提告請求返還或減少價金。

一審認為曾婦交易時，沒事先確認買賣條件，判曾婦敗訴；二審調查發現，鑽表部分，曾婦購買前，珠寶公司曾拿行銷目錄說明新表價值256萬元，卻沒提及該表是市價僅60多萬元的二手貨，足讓曾婦誤認新貨，須負商品瑕疵擔保責任，判還195萬多元的價差金。全案得上訴。
